OEM and Private Label Sex Toys: How the Process Actually Works
The word "private label" hides four separate decisions — who designs, who owns the tooling, who owns the packaging artwork, and who carries the compliance burden. Here is how to split them.

Buyers often assume private labelling is one thing with a price attached. It is four, and the split between them is negotiable. Getting the split right before the first sample is the difference between a product you own and a product you resell.

Decision one: design

Three options, in increasing order of cost and ownership. A supplier uses an existing mould and changes nothing but the colour. A supplier adapts an existing mould for your dimensions. Or you bring your own design and pay for tooling from scratch.

Ask who holds the copyright on the final 3D file. A written answer matters more than a verbal one, and "we keep it" is a common and workable answer.

Decision two: tooling

Option Typical cost Who owns it Switching cost later
Supplier's existing mould Lowest Supplier Low - but you have no uniqueness
Adapted mould Moderate, amortised into unit price Usually shared or supplier-held Medium
New tooling you fund High, one-off You, if it is written down High, but it is your product

If you pay for tooling in full, get a written tool-ownership clause naming the mould and its physical location. "We own the mould" protects the supplier; "we own the mould and it is stored in bay 4" protects you.

Decision three: packaging

Packaging is where private label is cheapest and most visible. Print costs are close to flat across suppliers, so this is a negotiation about setup fees and minimums rather than unit price. Design your own artwork or buy a template and edit it - but get written confirmation that the artwork file is yours.

Decision four: who carries compliance

This is the one buyers skip and then regret. In most markets the party that places the product on the market carries the obligation to hold and produce the relevant test report. If that is you, you need the report before you ship - not after a buyer asks.

The practical sequence is short: agree who designs, agree who owns the tooling, agree the artwork, and agree who holds the report. Four lines in writing, before the sample, is worth more than four pages after a dispute.
